Definitions

Throughout these terms and conditions

“I”, “myself”, “you”, “them”, “my”, “their” or “client(s)” refers to the attendee at one or more of Pure Form’s classes.

“Pure Form”, “we”, “our”, “us” refers to Edgetech Limited trading as Pure Form or any of its employees. 

“Missed class” is defined as a class in respect of which a client has contacted Pure Form to advise of non-attendance at least 24 hours in advance of the class. 

“Term” you contract with Pure Form on the basis of attending a set class (day of the week and time of day) for a pre-defined number of weeks.  Classes are booked and paid for in advance of the first course date of a term.

“Classes” / “session” refers to an individual unit of service.

“Course” refers to a term (all units of service paid for).

“venue” means the location of a class or session or course.

“medical form” is a form provided by Pure Form in hard copy that you include your medical data on

Contacting Pure Form

Pure Form can be contacted via telephone in normal office hours.  Details of the contact telephone number and office hours can be found on the website. 

Liability waiver

To the fullest extent permitted by law, I agree that Pure Form and its representatives shall have no liability for any loss, damage or injury of any sort which I might incur as a result of participating in any services offered by or any advice or feedback provided by Pure Form (which should never be considered to be medical advice). 

Pure Form does not limit or exclude its liability (if any) for any fraudulent misrepresentation or personal injury or death resulting from our negligence or for any matter which it would be illegal for us to exclude or attempt to exclude our liability.

Medical/health

I understand that prior to attending Pilates classes I must consult GP / medical practitioner regarding the suitability of Pilates to my medical circumstances and any modifications to exercises that I will require.   I understand that I am responsible for providing details of injuries, medical conditions, surgeries and allergies that might impact me whilst attending a class as well as details of any modification to exercises required / any exercises that cannot be performed / how I will manage my allergies.

I know of no reason why I should not participate in any form of physical exercise.   I accept full responsibility and consider myself fit to exercise. I understand that I attend Pilates classes at my own risk and that I am responsible for monitoring my own condition during physical activity and ensuring that I will work within my physical capability, stopping immediately if I experience any discomfort.

I agree to inform my teacher immediately if I feel discomfort during a session.  I also agree to keep my teacher updated after my session, should I experience any discomfort or pain during a class or after a class.

I understand that I must provide a signed medical form 2 working days before attending my first class.

Amendments to medical data

I agree to provide Pure Form with an updated medical form (again 2 working days before attending a class), should any data provided on my last medical form change.

Medical forms can be obtained by calling the office.  They can be returned to Pure Form either physically (you can arrange to drop in a medical form after a scheduled class by contacting the office) or you can return via post to: Pure Form, PO Box 40, Envoy House, St Peter Port, Guernsey.

I understand that medical data should never be sent via text / Facebook messenger / left as a voicemail as these may not be a secure and confidential means of transmitting data.  I agree that there will be no liability on Pure Form for any data protection breaches, or any loss or damage suffered as a result of data being shared by these means (text, Facebook Messager or voicemail).

General

By providing a postal address and phone number to Pure Form I consent to receiving postal and text messages communications from Pure Form in regard to my booking and other marketing material (provided that I have consented to such marketing on the booking form).

I understand that I am required to give written notice to the Company of any change of address. Failing such notice, all communications will be assumed to have been received by the Clients.

Venues

I understand that parking at any venue is offered on a “own risk” basis, with no responsibility / liability for any damage, theft or loss that may occur whilst parked or whilst accessing the venue.

I understand that coats and any other items brought into class should be stored in the designated areas in each venue and that items brought into class are at “own risk” basis, with Pure Form having no responsibility / liability for any damage, theft or loss that may occur whilst attending classes.

I understand that the venues will be open 5 minutes before the commencement of the class and that I should not enter the classroom if the tutor is not present.

Performing Arts Centre:

Kindly note that as there is a bar on-site that this venue does not allow drinks purchased from other retailers to be consumed on-site.  You can bring a filled reusable water bottle to the venue.  There is also a water fountain available on-site (the use of this facility is on an own risk basis, with Pure Form having no responsibility / liability for any damage or loss that may occur).  Kindly note that by attending classes at this venue you agree to any bags brought onto site being searched if the venue deems this necessary as the result of a suspected breach of their policy of bringing drinks / food onto site (this is a term required by the venue).

Castel Douzaine Room:

There is no water available on site and no restrictions in respect of bringing water purchased elsewhere.

Admittance to class/removal from class

In the interest of safety Pure Form reserve the right to refuse entry to any client arriving late to class, or clients who have not completed a medical form or / and booking form.  Pure Form also reserve the right to remove clients from classes if they are behaving in a unsafe manner.  No refunds will be provided.  To avoid being denied access to class, clients should:

  • Provide signed medical forms and booking forms in good time (2 working days before joining class)
  • Arrive on time
  • Only enter the teaching room if an instructor is in the room
  • Follow the instructions of the tutor

Force Majeure

Pure Form shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these terms if the delay was due to any causes beyond our reasonable control, including, but not limited to, acts of god, terrorism, explosion, flood, storm, fire, war or threat of war, riot, civil disturbance, restrictions, regulations, or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labour , fuel, parts or machinery, power failure or breakdown in machinery.

Delay in performing or failure to perform any obligations

We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these terms for whatever reason (whether this be illness, issues with the venue or any other reason).  We reserve the right to change the venue / date / session times / offer other resolutions (depending upon what Pure Form feels is appropriate in the circumstances) and refunds will not be offered.

We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these terms if the delay was due to sickness of the tutor.  In the event that the tutor is unwell, the session will be rescheduled / moved on-line / an alternative tutor might be offered.  No refunds will be offered.

Cancellation of classes by Pure Form

Pure Form reserve the right to cancel a course and to refund pro rata any fees for unused elements of the course, for example, for a 7-week course cancelled after completion of week 2, 5/7*the course fee will be refunded. Kindly note that this will not be considered to be breach of contract.

Refunds

Courses are booked by the “term” / “half term” and no refunds offered, if as a goodwill gesture a refund is provide, there is an administration fee of £30 which will be deducted, prior to the remaining fee being refunded on a pro rata basis. 

Missed classes

I understand that classes are booked by blocks of classes (i.e. by a 6 week “term”) and that if I am unable to attend a class I should contact Pure Form to advise of non-attendance at least 24 hours in advance of the class. Catch up classes can be booked, subject to space being available in an alternative class of the same / lower level than my current class.  Catch up classes should be pre booked and must be taken within the same “term” that the missed class was in.  No refunds are offered for missed classes.  Missed classes cannot be used against one-to-one classes / future terms. Please note, no reasons should be provided for non-attendance and no medical data provided if leaving a message on Pure Form’s voicemail.  If we have not been advised of a Missed class, no catch up class will be offered.

Covid-19

Clients should follow all applicable covid-19 guidance provided by the States of Guernsey on their website (www.gov.gg) and must not attend class with any symptoms of Covid-19 or other transmissible infections and diseases.  

By attending a private/group classes with Pure Form, I acknowledge and accept that there are risks associated with Covid-19 and other transmissible infections and diseases. I agree that Pure Form is not responsible for transmission of Covid-19 and other transmissible infections and diseases.

Safety & Hygiene

In the interests of safety, no crockery or glass is permitted in class. Attendees are welcome to bring water in a sealed plastic or metal container.  No other drinks should be bought to class.

Clients must use the main entrance / signposted alternative entrance (that the venue managers might specify) to the venue when entering or leaving. Smoking / vaping is not permitted in any venue used by Pure Form. 

Food is only permitted in class for medical reasons, if bringing food into class you take responsibility for your own health and the health of others.  You agree to not bring foods containing allergens including, but not limited to: nuts (peanuts, tree nuts), soya, eggs, milk, seafood, wheat, sesame, mustard, lupin, and celery.

I clients must wear suitably grippy socks, by attending a class clients agree that it is their responsibility to ensure that these provide sufficient grip to enable them to move safely during class and to wear outdoor footwear when not standing on their mat.

I understand that bags / large items should not be bought into class.

Accidents

I understand that in the event of an accident or injury, I will be requested to complete the accident book in duplicate, one copy for both Pure Form and one copy for the relevant venue.  I understand and I consent that I may receive follow up communications from both Pure Form and the venue, which may require me to provide an update on my health status for the purposes of RIDDOR, or just from Pure Form, to understand any changes to my wellbeing and medical status.

Governing law and jurisdiction

These terms shall be governed by and construed in accordance with Guernsey law and the parties hereby agree to submit the exclusive jurisdiction of the Guernsey courts.

Pregnancy/client age restrictions

Pure Form is unable to offer antenatal or postnatal Pilates courses and courses to those under the age of 18 years, as Pure Form tutors are not trained for these specialist disciplines. 

Therefore, if you are pregnant / have been pregnant in the past 4 months, Pure Form’s Pilates classes will be unsuitable for your needs.  We look forwards to welcoming you back to class a minimum of 8 weeks after the end of your pregnancy, subject to approval from a medical professional for you to return to Pilates without the need for any modifications as a result of your pregnancy and once any diastasis rectus abdominis is fully healed.  All unused classes in your course can be carried forwards until your return to class has been signed off and remain valid for a period of 18 months after the last class attended (subject to available drop in spaces in class).

Acceptance onto a course

Pure Form is unable to offer classes to those who are:

  • under 18 years of age;
  • those who are pregnant;
  • those who have given birth (uncomplicated) in the past 6 weeks and have not had sign off to resume attendance at regular (meaning not pre or post-natal courses) Pilates classes;
  • those who have given birth > 8 weeks ago, but have diastasis recti;
  • those whose GP / consultant does not deem them as fit to attend regular Pilates classes (meaning classes without post-natal adaptions); and
  • those with medical conditions requiring modifications that are outside of the skills of the tutor.

Individual classes

Pure Form reserves the right to require new clients / returning clients to attend a one-to-one class / classes prior to attending group classes.  If modifications to exercises are required, these classes will be charged at the normal one to one classes rates, which can be obtained by telephoning Pure Form.

Exercise modification

In the event (due to for example a medical condition), that exercises need to be modified for a client, I consent to the teacher, during the class, addressing me by name with a modification to the exercise / an alternative exercise.  By booking a group class, I consent to these verbal modifications being made during the group class and audibly to all participants.  If a client does not wish to receive modifications in this format, then clients should book one to one classes.
